May Is Motorcycle Safety Month

The month of May is dedicated to Motorcycle Safety Awareness. Sponsored by the National Highway Traffic Safety Administration (NHTSA), the campaign aims to remind drivers to be cognizant of motorcyclists during the busier summer months.

An estimated two-thirds of all motorcycle accidents occur with a passenger car. The NHTSA reminds us that there are simple steps to become more aware of motorcyclists on the roads:

* Give the motorcyclist a full name of travel. Remember the motorcycle deserves the same privileges of any vehicle on the roadway.

* Watch for motorcyclists on the highway – at intersections – when the rider may be making a left turn or changing lanes. Clearly signal your intentions.

* Obstructions you may avoid in your vehicle (i.e. pot holes, debris etc.) can be deadly for a motorcyclist.

* Always allow adequate space between you and a motorcycle – don’t follow too closely.

Motorcyclist In Good Condition After Crash

A motorcycle accident in Indianapolis left a Richmond man, 21, hospitalized but in good condition.

The accident happened Wednesday night, just after 6:30 p.m. on Wernle Road. The motorcyclist was traveling westbound on Wernel Road when he lost control of the bike and skid about 800 feet off the north side of the roadway.

Witnesses told Wayne county Sheriff deputies he was speeding. He suffered several fractures and internal injuries, according to police. He was not wearing a helmet.

Indiana Motorcycle Deaths Declined In 2009

A newly released study finds motorcycle traffic fatalities in Indiana declined more than 14 percent last year, reflecting a nationwide trend.

Motorcyclist’s death caused by drunk driving accident

As a motorcyclist myself, and a San Francisco motorcycle attorney, I write with a very heavy heart today. The San Francisco Chronicle reported earlier this month that a Richmond man, 35 year-old Anthony Walker, was killed while riding his motorcycle home from bible study class.

Adding to the tragedy is that the man who killed him, Juan Ruelas, 43, was intoxicated and unlicensed because of two previous drunk driving convictions. Ruelas attempted to flee the scene after the accident, but, luckily, a witness identified him and he was arrested. Apparently, both men were approaching an intersection at the time of the crash. Ruelas was making a turn and failed to yield, causing the accident.

Ruelas is currently in jail and has been charged with murder, as opposed to vehicular manslaughter, according to prosecutors, because Ruelas had a prior DUI conviction and had attended DUI classes showing that he knew that driving drunk was dangerous. Prosecutors believe that he knew that if he drove drunk again he could kill someone, but he allegedly went out and did it anyway, which, in legal terms, amounts to murder. His bail is set at $200,000.

While DUI deaths declined in California in 2008 (2009 statistics are not yet available), from 1,132 in 2007 to 1,029 in 2008, according to the National Highway Traffic Safety Administration's Fatality Analysis Reporting System, how many more senseless deaths will it take to put an end to drunk driving? If you lose your loved one, I am sure you would agree that even one death because of impaired driving is too much. Last October, California law was amended to include the requirement of an ignition interlock device as a pilot program from July 1, 2010, to January 1, 2016, in the Counties of Alameda, Los Angeles, Sacramento, and Tulare.

This law requires, as a condition of having the privilege to operate a motor vehicle reinstated subsequent to a conviction for a violation of drunk driving, a person to install for a specified period of time an ignition interlock device on all vehicles he or she owns or operates, Please join with me in urging legislators to shift this from a pilot program to a state-wide program and to continue to examine current laws and sentencing to see if there is more we can do to stop drunk driving and prevent senseless deaths.

Our thoughts and prayers are with Mr. Walker’s family during this sorrowful time.

Fatal Crash Claims Life of 23-Year-Old Charlotte Man

A Friday night crash in Eaton County took the life of a young man from Charlotte, Michigan. The accident occurred at the intersection of M-50 and Vermontville Highway. According to authorities, a pickup truck pulled out in front of the young man, who was traveling north on his motorcycle. A passenger on the motorcycle suffered non-life-threatening injuries and the occupants of the pickup truck were unhurt.

This motorcycle crash is another sobering reminder of the dangers motorcyclists face when they take to the road. While motorcycle riding can be a fun and exhilarating activity, it also has unique dangers that are not present when driving an automobile. Regardless of fault, a motorcyclist is far more likely to suffer more severe injuries in a crash than the occupant of an automobile. If you do choose to ride a motorcycle, wear a helmet and drive defensively. A little extra caution will go a long way in keeping you safe.
