Adrian Township Motorcycle Accident Injures Biker

A biker was seriously injured in an Adrian Township Motorcycle Accident  on May 12th. Biker Danald Hull rode his bike on M-52, just south of Valley Road, when when Mildered Owen turned in front of his Honda Goldwing Motorcycle. Donald was flown by Survival Flight to the University of Michigan Health Center in Ann Arbor. State police are still investigating the accident at this time. Ms. Owens was taken by ambluance to Bixby Medical Center for treatment of minor injuries.

The biker apparently had serious injuries to the head and chest.  His prognosis is unknown at this time.  My wishes for a prompt and speedy recovery go out to him.

Because this Michigan motorcycle accident involved contact with another motor vehicle, the biker should be eligible for Michigan No-Fault Insurance benefits.  This will provide for payment of medical expenses, lost wages, attendant care services, and other benefits.  For a complete explanation of the rights of injured bikers in Michigan, you should request our FREE BOOK, “The Ultimate Michigan Motorcycle Accident Handbook.”

The no-fault insurance laws are complex and confusing and it is imperative that the injury victims and their family members contact a Michigan motorcycle accident lawyer as soon as possible so that the claims process can be started.  There are strict deadlines for filing claims and submitting bills and if not met, the insurance company may be legally entitled to refuse payment for these claims.

Brain Injury Treatments

Motorcycle accidents unfortunately often involve accident victims who are severely injured.  Despite helmet laws, injured motorcyclists have higher rates of head trauma and brain injuries than people who are injured in cars or SUVs.

Brain injuries can have a tremendous effect on an injured motorcycle rider’s ability to lead his or her normal life.  A brain injury can cause changes in personality that affect marriages, families, and friendships.  Head trauma patients are often temporarily or permanently unable to return to work, and so they suffer a significant impairment of earnings and earning potential.  Further, brain injury patients often need expensive long-term care services due to their condition.  Part of the reason motorcycle accidents involving brain injuries are so devastating is that the brain is complex organ, which is still not completely understood.  This fact makes treating the brain injuries very difficult.

I recently read about a new brain injury treatment that focuses on using social clues to treat brain injuries.  Before this study was released, it was already widely known that brain injuries can cause personality changes and changes in behavior, which can create difficultly in dealing with social situations.  The study focused on re-teaching basic social skills to people with brain injuries.

For example, handling sarcasm often presents a great difficulty for people with brain injuries because sarcasm involves positive words which are spoken in a negative tone or manner.  People with brain injuries often have difficulty interpreting the mixed messages.

The treatment prescribed in this study involved increasingly sophisticated re-education as to how and why people send mixed messages in social settings and how to respond to them.  The patients reported some improvement in responding to new social situations, which is certainly a cause for hope for injured motorcyclists with brain injuries.

Bikers who sustained brain injuries in motorcycle accidents or their family members should contact Buckfire & Buckfire, P.C. immediately to determine their legal rights.  Our office will start working on your case immediately and begin gathering the evidence to prove and win your case.

Traumatic Brain Injury Damages | Michigan Motorcycle Accident Lawyers

Our motorcycle accident lawyers know that our client’s case is not over once we prove our client has suffered a traumatic brain injury.  Proving the extent of the damages our clients have suffered is a vital element in any motorcycle accident case, especially one featuring a traumatic brain injury.

The brain injury lawyers at Buckfire and Buckfire, P.C. have won substantial amounts for our clients from both jury verdicts and settlements.  Traumatic brain injury cases present some of the most difficult and complicated damages, because the brain is itself a complex organ that is not fully understood.  The full extent of damages might be slow in developing, and yet, there are often immediately noticeable changes in personality and mood.

Our Michigan brain injury lawyers understand that these changes in personality affect marriages, families, and friendships.  Traumatic brain injury patients are often unable to return to work and suffer a significant impairment of earnings and earning potential.

Damages in traumatic brain injury cases are often substantial, because they seek to compensate the injured person for the tremendous cost for their care and rehabilitation as well as, quite often, a lifetime of decreased earnings.  Accident victims who have suffered traumatic brain injuries generally can collect the following traumatic brain injury damages:

  • Medical expenses including all hospital and doctors’ bills
  • Pain and suffering, including future pain and suffering
  • Loss of enjoyment of life
  • Reasonable value for loss of time and earning capacity
  • Poor health or disability caused by the traumatic brain injury
  • Aggravation of a pre-existing injury caused by the traumatic brain injury

There are many excellent support groups for traumatic brain injury patients in their families throughout the United States that promote treatment, prevention, and education.  Most states have strong local chapters of the national associations, including a Michigan chapter.

Picking a Lawyer | Michigan Motorcycle Accident Lawyers

Many people think that a brain injury could never happen to them or a loved one.  But, did you know that brain injuries occur in nearly 75% of accidents that involve bodily injury?  Brain injuries are an extremely common result of motorcycle accidents and other accidents, including assaults, sports injuries, slip and fall accidents, and more.

If you or a loved one is ever in a motorcycle accident, the first thing you should do is seek medical treatment immediately.  Mild brain injuries are often difficult for lay people to detect, but left undiagnosed they can cause severe long-term problems such as headaches, memory loss, and even personality changes.  Such injuries can result in job loss, family strife, and significantly increased medical expenses later in life.

Many times, the negligence of another person causes a motorcycle accident, which can lead to traumatic brain injury.  When this is the case, the injured person or his or her family may be able to file a lawsuit against that person for their brain injury in addition to any insurance claim they might be able to submit to their insurance provider.  Not all lawyers are equally qualified to handle your motorcycle accident case, and you will want to make sure your motorcycle accident lawyer knows the technicalities of the law as well as the science behind brain injuries so your lawyer can explain your injuries to the judge and jury.  Failing to select the best lawyer could cost you benefits and reduce your chances of obtaining a favorable settlement.

When picking a car accident lawyer for someone with a brain injury, you will want to ask him or her the following questions to help you determine whether the lawyer has the knowledge and experience necessary to fight for you.

  • Have you handled car accident cases before?
  • What percentage of your law practice is devoted to representing injured people?
  • Do you know about different types of brain injuries?
  • Do you know what long-term health problems face someone with a brain injury?
  • Do you regularly represent clients against insurance company lawyers?
  • What kinds of settlements and jury verdicts have you obtained in similar car accident and brain injury cases?
  • Do you have a website with more information about brain injuries and the brain injury cases your law firm has handled?
  • What relationships with doctors, nurses, and brain injury associations do you have?

Traumatic Brain Injury Symptoms | Michigan Motorcycle Accident Lawyers

Our Michigan motorcycle accident lawyers frequently represent individuals who suffer brain injuries due to trauma suffered in motorcycle accidents and other accidents.

According to the National Center for Injury Prevention and Control, motorcycle and other motor vehicle accidents account for 20% of all traumatic brain injuries.

A traumatic brain injury can cause a serious disability and the effects can be permanent. Recognize the symptoms of a traumatic brain injury:

  • Coma
  • Persistent headaches or neck pain
  • Difficulty remembering, paying attention, or making decisions
  • Slowness in thinking, speaking, acting, or reading
  • Getting lost or easily confused
  • Feeling tired or lacking energy
  • Mood changes
  • Changes in sleeping patterns
  • Light-headedness, dizziness, or loss of balance
  • Nausea
  • Increased sensitivity to light, sound, or distractions
  • Blurred vision
  • Loss of sense of smell or taste
  • Ringing in the ears

Traumatic brain injury can cause a wide range of functional changes affecting thinking, sensation, language, and emotions.  The Center for Disease Control estimates nearly 5.3 million Americans suffer from a traumatic brain injury.

The Michigan motorcycle accident lawyers at Buckfire & Buckfire understand that these types of injuries have a tremendous effect on an individual’s ability to lead his or her normal life.  Changes in personality affect marriages, families, and friendships.  Head injury patients are often unable to return to work and suffer a significant impairment of earnings and earning potential.  Further, head injury patients often need expensive long-term care services due to their condition.  Fortunately, Michigan No Fault benefits may be available when a person suffers a traumatic brain injury due to a motor vehicle accident.

The injuries resulting from traumatic brain injuries are often permanent, and cases involving brain injuries have substantial value for both jury verdicts and settlements. This is because of the tremendous costs and expenses related to caring for a brain injured child and the loss of a child’s earnings over his or her lifetime.

There are many excellent support groups for brain injury patients in their families throughout the United States that promote treatment, prevention, and education.  Most states have strong local chapters of the national associations, including a Michigan chapter.
