Michigan Road Defects and Potholes

Many bikers in Michigan are seriously injured due to road defects and inadequate maintenance on our streets and highways.  These injuries are often catastrophic or deadly.  Common defects include potholes, raised and cracked pavement and cement, excessive stones and debris in the roadway, and dangerous highway shoulder dropoffs.  Motorcycle accident victims injured by road and highway defects do have legal rights to be compensated for their injuries.

Under Michigan law, the government agency responsible for the roadway can be liable to an injured biker if the roadway is not safe and convenient for public travel.  It is essential to photograph the scene of the accident and the actual road defect as close in time to the accident as possible.  Hopefully this will be before the road commision repairs the hazard. 

To make a claim for a road or highway defect, the injured person or their representative must give the government agency responsible for the roadway written notice of the defect within 120 days of the accident.  The notice must provide the date of the accident, the location of the accident, the nature of the defect, the names of any witnesses, and the injures suffered by the biker.  The failure to provide this written notice within the proper time frame will bar the claim forever.
