Wage Loss Claims | No-Fault Insurance

One of the most important aspects of Michigan No Fault insurance is that it will pay wage loss benefits if you are injured in a Michigan motorcycle accident and qualify to receive these benefits.   The Michigan No-Fault law, requires that the responsible insurance carrier pay for “work loss benefits” when injuries from an accident cause disability from employment.  The purpose of work loss benefits is to compensate injured persons for the employment income they would have received if the accident had not occurred.

Section 3107(1) (b) states “Work loss consisting of loss of income from work an injured person would have performed during the first 3 years after the date of the accident if he or she had not been injured.”  A person is entitled to 85% of their gross lost wage up to the monthly maximum.  The monthly maximum for the period from October 01, 2007 through September 30, 2008 is $4,713.00.  This amounts to a maximum of $56556.00 per year.  These amounts change every year due to inflation.

In order to recover for your work loss benefits, a person must submit several documents to the insurance company.  These include an Application for No-Fault Insurance Benefits; a wage, salary and benefits verification form from your employer; and a doctor’s disability slip or other verification of disability from employment as a result of the injuries from the motor vehicle accident.

Even if you are temporarily unemployed at the time of the accident or actively seeking employment, you may be entitled to work loss benefits.  This is also true if you are a seasonal employee, like working for a lawn maintenance company, and are disabled from work.  An experienced Michigan motorcycle accident lawyer can help you determine if you are entitled to work loss benefits.
